California “Access to Justice in Family Court” Law Panel

The UCtelevision program “Access to Justice in Family Court” embedded below features a panel of 5 legal professionals filmed on November 14, 2008, discussing the problems of access to justice in California family law courts. The primary focus of the discussions is the problems of providing court services to unrepresented litigants which comprise 70% or more of those in the family law courts in the state. This includes a discussion of “limited scope” representation in which parties can get help from attorneys without fully engaging them for hundreds of hours of work. This video is worth a watch for anybody interested in the family law system in California.

Stephen Doyne and San Diego Family Law Courts Under Fire

What started with a dispute over allegedly fraudulent credentials and work history of San Diego County, California, family law section 730 child custody / psychological evaluator Stephen Doyne is expanding to encompass the entire family law court system in the county. Flying about are accusations of corruption, irresponsible conduct, law violations, and other problems committed by judges, judicial staff, lawyers, and the large community of “professionals” associated with the San Diego family law courts who make their living off the conflict and misery of divorced families from which they profit and in some cases encourage.

Psychological Evaluator Stephen Doyne, Ph.D. Sued for Fraud

Local TV channel KGTV (channel 10) news aired a story about the problems with psychological evaluations in the county and with Stephen Doyne in particular. Doyne is being sued by father Emad Tadros who is deputy head of psychiatry for Scripps Behavioral Health Services which is a large health care organization in the area.

Tadros is suing Doyne in relation to a psychological evaluation he performed connected with a child custody dispute. Based upon court records, the problem case involves both Tadros and mother Yvonne Leijen. Leijen filed a paternity claim in 2004. In 2009, she filed domestic violence actions against Tadros. Oddly, she filed actions on the same day in two courts — both Central San Diego and North County Vista courts. Such filings are routine tactics in California child custody battles, even when no domestic violence exists.

Doyne is claimed to have misrepresented his credentials and work history. To pump up his reputation, he lists a diploma-mill certificate from an organization that has even issued such a certificate to a pet cat.

Foster Mom Jennifer Montag Charged With Child Molestation

That disturbed mug you see to the left is foster mom Jennifer Ann Montag. Montag, a 40 year old Weber County, Utah foster mother, is another of the very caring foster moms chosen by the careful selection process used by a CPS agency. You’d think this process should be a snap in Utah. As you may know, Utah feels like a throwback to the days when crime didn’t pay and streets were safe. The citizens have strong family values and widespread involvement in the Church of Jesus Christ of Latter Day Saints, commonly known as the Mormon church. Personally, very nearly every Mormon I’ve ever known has been a polite, responsible, and decent person. Many of them are very devoted to community service, too. So you’d think that in Utah, finding good foster parents would be easier than in much of the United States.

Profile of a Caring Foster Mom: Jennifer Montag

The government did find a very caring foster parent in Montag, but not of the sort you might expect in Utah. Montag cared so much about her 14 year old foster son that she bedded him, allegedly had sex with him repeatedly, and when discovered threatened to kill herself if she was exposed and couldn’t be with her young love any longer.

Recognizing Borderline Women

Borderline women are generally abusive to those around them, particularly to their husbands, boyfriends, partners (including women partners — lesbians and bisexuals can be Borderlines just as heterosexuals can), and children. It is important to realize that many Borderlines were abused as children, some have genetic tendencies for extreme emotional behavior, and some have both characteristics. Recognizing a Borderline often depends upon noticing how they affect the people who are their close family and friends. These people often are afraid of the Borderline and can spend years being manipulated and controlled via abusive tactics, rages, and false blaming. The Borderline will often have endless complains about all of these people, seemingly justifiable unless you have actually met and seen them and therefore know that they are not the source of the problems.

Framed for Child Porn by a PC Virus

The Associated Press has recently published news of an investigation it conducted into people being framed for child pornography by the use of computer viruses and other malware. The results make it clear that innocent people are having their lives ruined by government witch hunts for child pornography after unknowingly becoming victims of computer viruses.

Michael Fiola’s computer was infected by a virus that cost him his job, his life savings, and nearly his freedom. His life was threatened repeatedly. Even his car tires were slashed by somebody who heard the accusations against him. All this happened because the virus downloaded child porn to his computer and the government persecuted him for years before finally admitting that they couldn’t prove their case.

Zazzle is a web-business that enables people and companies (even big ones like Disney!) to design their own products with custom art, either for their own use or for resale. They and their customers can print the art on a variety of goods, from T-shirts to coffee cups to bags — even shoes!

I was looking at their web site the other day and saw this “diaper changing instructions” design and laughed out loud. Simple, but it gets the point across. It’s a good use of their custom product manufacturing prowess. You can get it on a variety of kid and adult size clothes, even including baby onesies!

This design might make a good humorous gift for a number of purposes.

  • You’re trying to prepare your significant other for the idea of having (more) children.

Are Sarah Palin and Family Serial Parental Alienators?

Although they may seem strange bedfellows, former Governor of Alaska and US VP candidate Sarah Palin (Republican) and smallfry pandering child abuse proponent Jim Beall (Democrat – California Legislature) may have more in common than meets the eye. Both appear to have attitudes towards fathers that suggests they regard denying them contact with their children via access blocking and false accusations. They believe these should be tactics vicious women can legally use without regard for their children. Both think that this form of emotional child abuse known as parental alienation should be ignored and not considered in child custody decisions. Yet child psychologists consider parental alienation of great harm to children.

Palin Family: Serial Parental Alienators?

Sarah Palin and her family have been accused of alienating her daughter Bristol’s child Tripp Johnston from his father, Levi Johnston. Levi Johnston and his sister Mercede claim that the Palin family blocks his attempts to see Tripp. He is contemplating legal action against them to regain time with his son. While detractors point to Johnston being a high-school dropout with a variety of family and personal problems, it looks very likely that the Palin family really does have a problem with parental alienation against ex-relatives they want kicked out of the family and are willing to go so far as using defamation campaigns and frivolous restraining orders to accomplish their despicable goals.

“Levi tries to visit Tripp every single day, but Bristol makes it nearly impossible. She tells him he can’t take the baby to our house because she doesn’t want him around ‘white trash’!” Bristol won’t even allow him to watch the baby for a few hours — unless he’s babysitting!

The worst part, Mercede continues, is that the former vice presidential candidate supports Bristol’s treatment of Levi, 19. “I used to love Sarah,” Mercede says sadly. “But I’ve lost lots of respect for her.”

1 in 4 Children of Divorce Suffer Parental Alienation Syndrome

Psychology researchers Jose Canton Duarte, Rosario Cortes Arboleda, and Dolores Justicia Diaz from the University of Granada have written a book on the psychological problems caused by parental alienation during child custody conflicts entitled Conflictos entre los padres, divorcio y desarrollo de los hijos (English: Marital Conflicts, Divorce, and Children’s Development). In much of the United States and of course in countries south of the border, there are a large number of families going through difficult divorces who speak Spanish as their primary language. While there is a wealth of English-language information on the form of emotional child abuse known as parental alienation, the selection of such titles for Spanish-literate populations has been more limited. If you know of a Spanish-speaking family with intense conflict between divorced parents, this title might be helpful for their extended family to read to understand what is happening to the child who used to love them but who now avoids and even lies about them after being brainwashed by the parent who has primary custody.

Death by Divorce? Fire, Custody Dispute Yield Death Sentence

Daniel Dougherty of Philadelphia has suffered many bad events in his life. He’s a former auto mechanic with alcohol addiction problems. He has had two broken marriages. But two of the tragedies stand out from the rest. In 1985, his girlfriend’s house burned down, killing his two sons who were asleep upstairs. In 1999, his second ex-wife was involved in a nasty child custody dispute with him. She reported to police that Dougherty set the 1985 fire which killed his children. She reportedly later retracted her claims, but it wasn’t enough to save Dougherty from a miserable fate.

The wheels of law enforcement whirred, people “changed” (falsified) their testimony to match the new story, and 14 years after that tragic fire, Dougherty was arrested. In his trial in 2000, he was sentenced to death for what appears could be a false allegation made by a nasty woman who couldn’t accept sharing child custody and was perhaps willing to see her ex-husband dead rather than accept joint custody.

Luzerne County Bribes 7 Year Old Boy for Arson “Confession”

Not even a 7 year old child is safe from law enforcement persecution. At least that’s the case when you have Luzerne County, Pennsylvania, involved and Judge Mark Ciavarella was on the case. You may remember him from the $2.6 million (revised estimates are now pegging it at $2.8 million!) “kids for cash” rule of cruel and illegal injustice by him and his buddy in crime Michael Conahan.

Here’s another story from about four years before the discovery of the thousands of cases of judicial corruption that justify the death penalty for Ciavarella. In this one, cops bribed a 7 year old boy with candy and pizza to get a confession for a fire he couldn’t have possibly set. Further, the victim of the fire, elderly Mr. Benjamin Morris, was known to burn yard waste and debris in his backyard and may have started the fire himself.

Luzerne County “law enforcement” didn’t bother to question anybody who was taking care of the boy that fateful day. Why bother when you are criminal thugs with badges who already have somebody you can easily blame for a crime and can be cheaply made to self-incriminate?

Can’t Punish Dead Man, So Punish Little Boy

Dead Benjamin Morris of course couldn’t be punished for the fire, so the government targeted a 7 year old boy instead. They wanted another arrest and conviction on their score cards, and since building the case for the prosecution could be paid for largely via twenty bucks of candy and pizza, it was a a cheap and easy “win-win-win” for the police, prosecutor, and corrupt judge. Ciavarella ripped him away from his family and sent him away for “treatment” for a “crime” that not only was probably not committed by him but was quite possibly an accident caused by the dead victim. That these wrongful actions by the government harmed a little boy and his family does not matter to the corrupt officials of Luzerne County.
